January 1, Federal Judge Overrules Ban on Drag Queens

A federal judge in Texas has handed down a ruling, stating the new law restricting public drag performances is a violation of constitutional speech rights. This ruling has resulted in the permanent discontinuation of the law’s enforcement.

U.S. District Judge David Hittner wrote in his decision, “Not all people will like or condone certain performances,” drawing a parallel between the varying preferences for performances to differing tastes in music or comedy, and emphasizing that these differences do not negate First Amendment protections.

This law is not a standalone case, with Texas being one of over a dozen states that have attempted to implement restrictions on drag shows, a move seen as part of broader Republican initiatives to regulate LGBT behaviors. Similar laws have been enacted in three other states.

Judge Hittner labeled the Texas law as discriminatory and vague, specifying that drag performances are not obscenely intrinsic and are a form of expressive speech, thus protected by the First Amendment of the U.S. Constitution.

The American Civil Liberties Union of Texas, drag performers, and Pride march organizers united in a legal battle, filing a lawsuit in Houston’s federal court to challenge this law. They argue modern drag, a form of expressive musical and dance performance, has its roots in LGBT venues.

The office of the Texas attorney general defended the law, which, among other things, banned the display of exaggerated male or female sexual characteristics in public or where minors could see, asserting it is essential for protecting children from “sexually explicit” content. Those found violating could face fines and up to one year in jail.

However, critics of the law believe it has been written so broadly that it could potentially criminalize performances by pop stars and cheerleaders and is directly targeting LGBT performers.

In alignment with this ruling, other federal judges in states like Tennessee, Florida, and Montana have also struck down similar drag restrictions, citing them as free-speech violations.

    It was probably a liberal judge that allowed perversion to win out.

    Drag queens don’t need to be around kids. And those against it are freaks who hate morality and children. It’s a shame so many thing drag queens are kid-friendly and so many defend those freaks.

    This is BS. If there are underage (Children) around, it should be enforceable as a criminal violation of decency laws.

    I am so grateful I am old.,.and that my children are older, & their kids are older….As a society we have lost our moral direction…and moral compass. What craziness adults choose to engage in…is their business…their world…but when did it become normal to bring children into adult world of Smoking, voting, drinking, x rated movies, etc. Why are we robbing children of childhoods?????

    HISTORICALLY, and TRADITIONALLY SEXUAL PERVERSIONS have been BANNED ROM PUBLIC DISPLAYS.

    Obviously the ‘judge’ has an agenda to push with all the power his position holds.

    Follow the money… Quit attending or patronizing any place or funding anything that condones such nonsense. When we all start avoiding any recognition of these wierdos they will quit doing it. Not sure how we get rid of wierd judges! They can let the Drag’s perform, but they can’t make you attend!
