January 1, Supreme Court Gift: Trump’s Trial Delayed, Election Interference Allegations Linger

Even Jeffrey Toobin, a legal expert who is far from being a Republican, concurs that the Supreme Court’s decision to hear the ex-president’s argument that presidential immunity shields him from criminal prosecution is a “gift”. This is irrespective of whether the court eventually sides with him or not.

Toobin explains that this is a “gift” because the timeline almost certainly guarantees that there won’t be a trial before Election Day.

In August last year, special counsel Jack Smith indicted Trump on four charges related to election interference. Smith had intended to start the trial in January. However, U. S. District Judge Tanya Chutkan felt that this timeline did not provide Trump with enough time to prepare his defense. As a result, she set the trial date for March 4, a day before Super Tuesday.

However, the trial was thrown off course in December when Trump challenged Chutkan’s ruling that presidential immunity did not protect him in this case. This appeal immediately put a stop to court proceedings, which have remained on hold for over two months now.

Smith has consistently urged the courts to speed up rulings on the issue, emphasizing the “public interest” and “national interest” in the case. Smith’s intention is to have a trial conclusion before Election Day, and he is concerned that any delay, regardless of whether Trump’s constitutional rights are respected, increases the chance that there will be no jury decision before Nov. 5.

It’s evident that the Supreme Court does not share Smith’s sense of urgency.

The Supreme Court not only scheduled oral arguments for the week of April 22, two months from now, but also instructed the D. C. Circuit Court to maintain its ruling until they issue their own, which will likely not be until the end of June.

With court proceedings on hold until the Supreme Court makes its decision, Trump’s trial will be postponed until late summer at the earliest. This poses a significant problem for Smith due to DOJ policies prohibiting election interference.

Harvard Law School professor Jack Goldsmith, despite not being a Trump supporter, believes that Smith’s haste, clearly with the election in mind, already “appears to violate” the DOJ’s Justice Manual.

Goldsmith explains, “If this were any other defendant than Donald Trump, the rush to trial—which cannot possibly give the Trump legal team adequate time to prepare its defense—would be deemed wildly unfair. Prosecutors and judges typically give defendants significantly more temporal leeway in trials of lesser magnitude with less severe charges.”

Liberals are fuming because they believe Trump is guilty, regardless of the presumption of innocence, and they view any further delay in court proceedings as a delay of justice. In short, they believe the ends justify the means.

However, Goldsmith strongly disagrees with this approach. He believes it is “uniquely harmful” to American democracy.

“The Biden Justice Department rushing to put away Biden’s political opponent is uniquely harmful,” he wrote this month. “The damage to our institutions from this outcome — to belief in the legitimacy of the presidential electoral process, and to the integrity of the Justice Department and the possibility of apolitical justice — is unknowable, but it is very likely to be serious and with us for a long time.”

Liberals are fuming, but their haste to convict Trump without a fair trial is “uniquely harmful” to American democracy, as Harvard Law School professor Jack Goldsmith points out.

    I am commenting on the rush to have a trial without considering the lack of time for defendant’s lawyers to prepare a proper defense. Anyone who truly loves this country and the freedoms as well as the responsibilities we each have will want any seemingly unfair pressures to be measured by the constitution of this great nation — and all it has meant over the years that makes this country so desirable as a place many in the world want to live even if it means traveling via troubles and harsh realities to get here. They are coming in droves and it is every elected offical’s as well as every citizen’s responsibility to do everything in our power to protect and embrace our Constitution — and the laws that are the quide for keeping this country great with the FREEDOMS we all enjoy.

    And, as the sole basis for this, and other, legal actions is to keep Trump from running, it is the most blatant political witch hunt in US history. No one really believes that Trump did anything serious, but the feeling that if Trump runs he wins, makes the left-wing (NOT LIBERAL. THERE ARE NO LIBERALS. LIBERALS DO NOT BELIEVE IN DESTROYING CIVIL RIGHTS) desperate to make the decision for the voters, as they know that Bidet could not possibly win a fair election. Your article would have more credibility if you stopped using the time-warn right-wing slur of liberal, when liberal has nothing to do with what is going on in the US. It shows ignorance to keep saying ‘liberal,’ when even the most cursory examination of the word proves that the left-wing is the antithesis of anything liberal.

They think that if they tell the lies, long enough that we will believe it. Here in Virginia, we have two of the worst LIARS of all times telling the lie. Mark Warner and Tim Kaine are the worst, they are the leading cause of ruining Democracy. I wish they would both have a fatal accident. Both are career LIARS and Cheats.     I am not a Trump supporter either. However I am deeply concerned , even as a Democratic voter most of the time, that Biden’s Justice Department seems to swing for hone runs against Trump and anyone affiliated with him, but tends to excuse The President and his son. That seems wildly unfair and an abuse of powers.

    In the book “Rating America’s Presidents” by Robert Spencer (which came out in the summer of 2020, that author’s baseline for giving 10 out of 10 stars to any president was this: How
    conscientiously did that president adhere to the US Constitution? Turns out only 4 US presidents got 10 out of 10 stars for their adherence to the US Constitution;
    George Washington, Abraham Lincoln, Calvin Coolidge, and Donald Trump. I am not selling this book. I am not related to the author. But I am bringing these facts to light because without our Constitution, what kind of nation would we be? And if any U.S. president did not adhere to the US Constitution, then what kind of president is that man? And this does not mean you have to like Donald Trump personally. But you must, if you are a thinking person, acknowledge his excellent service while he was president of the U.S. I personally hope he can run again and win
    in Nov. 2024. I will vote for him, and so should every freedom loving American.

    Jack Smith indictment of Trump on four charges related to election interference should be dismissed since Smith has not been appointed.
