January 1, DOJ Sues Texas Over Bold Immigration Enforcement Law

The Biden administration’s Department of Justice (DOJ) is suing Texas to prevent the state from arresting migrants who violate U.S. immigration law by entering illegally, according to an announcement made on Wednesday.

The DOJ is following through on its threat to sue Texas over enforcing S.B. 4, a new law signed in December 2023 that allows local and state authorities to arrest and prosecute individuals suspected of entering the U.S. illegally.

Texas has experienced a massive influx of migrants arriving at its border with Mexico, with illegal immigration surging to record levels under the Biden administration.

The DOJ stated in a press release, “The Constitution assigns the federal government the authority to regulate immigration and manage our international borders. Pursuant to this authority, Congress has established a comprehensive framework governing the entry of noncitizens into the United States and the removal of noncitizens from the country.”

The DOJ seeks a declaration that S.B. 4 is invalid and an order preliminarily and permanently enjoining the state from enforcing the law, claiming it is preempted by federal law and violates the U.S. Constitution.

In 2023 alone, the Biden administration caught and released over 824,000 illegal immigrants at the southern border, along with intercepting more than 229,000 pounds of drugs, including approximately 22,000 pounds of fentanyl.

Republican Texas Gov. Greg Abbott told the Daily Caller News Foundation, “President Biden has repeatedly refused to enforce federal immigration laws already on the books and do his job to secure the border.

In his absence, Texas has the constitutional authority to secure our border through historic laws like S.B. 4. Texas will take this fight all the way to the U.S. Supreme Court if necessary to protect Texans from President Biden’s dangerous open border policies.”

Since President Joe Biden took office in January 2021, an estimated 3.8 million migrants have entered the U.S., according to the New York Post. December 2023 saw the highest monthly figure ever recorded, with federal law enforcement encountering approximately 300,000 migrants at the southern border.

Principal Deputy Assistant Attorney General Brian M. Boynton, head of the DOJ’s Civil Division, said of the lawsuit, “Texas cannot disregard the United States Constitution and settled Supreme Court precedent. We have brought this action to ensure that Texas adheres to the framework adopted by Congress and the Constitution for regulation of immigration.”

House Republicans are reportedly planning an impeachment hearing for Department of Homeland Security (DHS) Director Alejandro Mayorkas, who partially blamed the surge in immigration on climate change.

The White House, which assigned Vice President Kamala Harris to lead an effort to stem the tide of illegal immigration in 2021, claims that nobody has done “more” with regard to the border than Biden and that the administration is “stopping the flow” of illegal immigration.

Neither the White House nor the DOJ responded immediately to requests for comment.

The Biden administration’s DOJ is suing Texas over its attempts to protect its citizens and uphold immigration laws. The federal government’s refusal to enforce existing laws has led to record levels of illegal immigration, endangering American lives and national security.

Texas Governor Greg Abbott is right to stand up to this administration’s dangerous open-border policies. By suing Texas, the DOJ is attempting to undermine state sovereignty and further weaken our nation’s immigration enforcement. The safety and security of American citizens should be the top priority, not protecting illegal migrants who violate our laws.

    Well, the feds aren’t doing anything at the border, so states have to. Or take them all to the White House since biden loves them so much.

      Instead of bussing to sanctuary cities and states, send every one of the illegals to DC and drop them off right in front of the White House. I bet something gets done quick like.

    It seems somebody is missing the fact that the sovereigns in the Union are the body politics of each State. Border protection was set in place for their own defense and they thought the Federal Government would do so. It isn’t happening.
    But even worst, illegals wind up in States’ territory and the States never relinquished that sovereinty to no one. They merely delegated some protection to the Union but did not resigned to their ability to do so.

    This should be a joke if it weren’t so sad. Basically, the DOJ is saying to Texas, “how dare you create laws to enforce the law!” I think somewhere in the constitution it also says that issues that the federal govt will not do should be left to the states, so I’m not sure the DOJ will win this.
