Federal prosecutors announced they won’t appeal a judge’s decision scrapping the death penalty in Luigi Mangione’s case for killing UnitedHealthcare CEO Brian Thompson.

The 27-year-old Ivy League grad now can’t face execution at his federal trial.

In a Friday letter, Deputy U.S. Attorney Sean Buckley told Judge Margaret Garnett the Southern District U.S. Attorney’s Office skips the 2nd Circuit appeal.

The Department of Justice will not seek interlocutory review of the Court’s Order prosecutors wrote.

Mangione faces a stalking charge federally that prosecutors link to Thompson’s death, father of two.

No murder count in federal court. Jury selection starts September 8, openings October 13.

A state murder trial kicks off in June where New York law means life in prison max, no death penalty.

Mangione pleads not guilty to the murder.

    Liberal Judge does not want the death penalty for: PREMEDITATED MURDER!!!
    He planned the murder, had a general time the victim would be there, and waited specifically for him! Then just shot him like he wasn’t even a Human Being!
    BUT this “Judge” doesn’t want him to be able to get the Death Penalty… POS in my opinion
