New York Attorney General Letitia James is pushing to block federal subpoenas related to her lawsuits against former President Trump and the NRA. She argues that Acting U.S. Attorney John Sarcone does not have the legal right to lead the investigation or issue subpoenas.

Her lawyer, Hailyn Chen, told the judge that since Sarcone was not officially appointed, actions he’s taken in the role, including subpoenas, should be ruled invalid.

“Sarcone exercised power that he did not lawfully possess,” Chen said in court.

Department of Justice lawyers claim Sarcone’s appointment is legitimate. Assistant U.S. Attorney Richard Belliss argued that removing Sarcone would be an “extreme” step and not the right solution.

“We don’t think that’s a proper remedy,” Belliss told the court.

The judge did not say when she would announce a decision after questioning both sides. The current dispute began after Sarcone held the position in an interim capacity and was later re-appointed by Attorney General Pam Bondi as a special attorney and first assistant U.S. attorney. Federal authorities say this allows him to act in the role as investigations continue.

Belliss explained that Bondi has broad authority to assign attorneys in the Justice Department and that Sarcone could still lead grand jury probes even if there’s debate about his title.
