Wyatt’s Take

  • California faces a lawsuit for drawing congressional districts with racial intent.
  • Plaintiffs argue the map violates their rights under the Constitution and Voting Rights Act.
  • The case highlights growing controversy over race and redistricting in America.

California’s new congressional map is under fire for allegedly using race to shape district boundaries. Several residents, backed by the Public Interest Legal Foundation, say the state’s map is illegal and was designed to give Democrats an edge.

PILF claims the redrawn lines are unconstitutional because they target racial groups by creating majority Hispanic and ‘influence’ Black districts. The group believes this move breaks the Fifteenth Amendment and the Voting Rights Act.

“Plaintiffs are California residents and voters who were injured when Proposition 50 deliberately enacted district boundaries created for racial purposes and with racial tools,” the lawsuit states.

The lawsuit points to Paul Mitchell, the map’s data scientist, who openly talked about factoring race into district decisions. When asked about Los Angeles districting, Mitchell noted, “we’ve actually gained Latino population, so why would you remove districts from a Latino community that has been historic and has a lot of community of interest arguments in that district. Why take that out when you can just leave it there and let all of the districts in LA push out over the county area.”

This is the second court challenge to the new map. It follows another case supported by the California GOP and joined by the Department of Justice.

Meanwhile, the use of race in drawing voting maps is also in the national spotlight. The Supreme Court is hearing a related case from Louisiana, which could set the tone for future redistricting across the country.
