A federal judge in Miami appointed by Joe Biden has thrown out a case against a migrant accused of voting in the 2020 election. The judge ruled that Congress cannot enforce laws banning noncitizens from voting.

The decision came in a case involving a noncitizen charged with illegally casting a ballot. Rather than letting the case proceed, the judge declared the federal law unconstitutional.

“The federal prohibition on noncitizen voting is unconstitutional,” the judge wrote in the order dismissing the charges.

The ruling effectively strips Congress of its authority to protect the integrity of federal elections. Critics argue it opens the door for more noncitizen ballots to count.

Supporters of the decision claim the law violates equal protection principles. They say noncitizens who live in the country should have the same voting rights as citizens.

“This is not about election security; this is about expanding who gets to decide our future,” one immigration enforcement advocate said.

The case now joins a growing list of court decisions that limit the federal government’s ability to enforce voter eligibility rules. States are left to decide whether to challenge the ruling on appeal.
