The Supreme Court is gearing up for what one top legal mind is calling the “Super Bowl” of cases — and President Trump’s signature immigration fight may not go the way conservatives hoped.
Jonathan Turley, a constitutional law professor at George Washington University, laid out his predictions for the explosive term finale. His verdict on Trump’s birthright citizenship executive order? Brace for disappointment.
“This is probably going to be a loss,” Turley told Fox News, pointing to the mountain Trump’s legal team has to climb.
The case centers on Trump’s executive order targeting so-called “birth tourism” — the practice where foreign nationals enter the U.S. specifically to give birth and secure American citizenship for their children. Trump’s order attempts to narrow the interpretation of the 14th Amendment’s citizenship clause, which grants citizenship to those “born or naturalized in the United States, and subject to the jurisdiction thereof.”
Turley explained the legal maze ahead for Trump’s attorneys. They must convince the Court that children born to illegal immigrants fall outside the “jurisdiction” language of the Constitution — a tough sell given decades of precedent.
“You have to show that illegal immigrants are not subject to the jurisdiction of the United States,” Turley said.
He noted the uphill battle, citing the 1898 case *United States v. Wong Kim Ark*, which extended birthright citizenship to children of legal immigrants. That decision has been a thorn in the side of immigration hawks ever since.
“If you read the debates [of the 14th Amendment], the framers were primarily focused on making former slaves citizens. But there was also this concern about Native Americans,” Turley explained.
The question boils down to whether illegal immigrants — who violate U.S. law by their very presence — can be considered fully under American jurisdiction in the same way as legal residents.
But Turley didn’t stop there. He ranked the other blockbuster cases the justices will decide before the term wraps.
“The big cases coming up are really quite a trifecta,” he said.
First up: Trump’s executive order pulling federal funding from so-called “sanctuary cities” that shield illegal immigrants from deportation. Turley believes Trump has the upper hand here.
“That one I think the president is likely to prevail on,” he said, noting that federal courts have long upheld the government’s power to attach strings to taxpayer dollars.
Next: Trump’s order nixing transgender ideology in the military and federal agencies. The left is howling, but Turley says the Constitution is on Trump’s side.
“The president has Article II authority as commander-in-chief. I think he’s got a good argument there,” Turley added.
Finally, there’s the foreign policy powder keg — Trump’s decision to pull out of the World Health Organization and his threats to reclaim the Panama Canal. Turley says these cases will hinge on the limits of presidential power in international affairs, an area where courts have historically given the executive branch wide latitude.
The stakes couldn’t be higher. These rulings will set the template for executive authority for decades — and determine whether future presidents can govern without being strangled by activist judges and deep-state bureaucrats.
Turley’s take is a cold splash of reality for Trump supporters banking on a clean sweep. But even if the birthright case falters, wins on sanctuary cities, transgender mandates, and foreign policy could still mark a monumental victory for constitutional conservatism.
The left is already in meltdown mode. Expect hysteria to ramp up as decision day approaches.

I pray the Supreme Court will ban birthright citizenship, because to allow it to continue will Destroy our Country’s citizenship laws and allow illegal aliens to over run the sanctity of legal Immigration Laws and allow a back door to circumvent The Privilege of true citizenship. 😡

I wholeheartedly agree with you. It is a known fact that foreigners come to the US just to give birth. They have no allegiance to our country at all. I pray along with you that the SCOTUS fully understands the consequences if we continue as we are.

I am afraid we are out of luck with the Supreme Court you have the head man Justice most of the time he goes against what is important i believe in freedom. If someone don’t do something about what’s going on in USA it’s about to come a 3rd world country. They are trying to do that all these so called Judges need to wake up. We have a president is trying to get the country in order but these judges is using their personal opion to ruin this country.Just because ha e a president standing for the Country

I don’t believe the forefathers intended for the law the constitution to be twisted in this manner. I also hope the supreme court will stop this nonsense that will put themselves in the position of the forefathers. America has been abused long enough
