In a stunning move, Trump-appointed Justice Amy Coney Barrett wrote the majority opinion. She argued that federal election-day statutes do not override Mississippi’s law allowing mail-in ballots postmarked by Election Day to be counted if they show up within five days after polls close.

Let that sink in. Ballots arriving nearly a week after Americans vote can still be counted. That’s not how elections are supposed to work in a functioning republic.

The ruling effectively gives a green light to the ballot chaos that plagued the 2020 election. Memories are still fresh of election nights turning into election weeks, with results trickling in as mysterious batches of mail-in ballots kept appearing.

Barrett’s opinion claims this arrangement doesn’t conflict with federal law requiring states to hold elections on a single day. But millions of Americans see through that legal gymnastics. If ballots can be counted days later, how is that really one election day?

Trump-supporting Americans who celebrated Barrett’s confirmation are left wondering what happened. She was supposed to be a constitutional originalist who would protect election integrity, not enable the mail-in ballot free-for-all.

The timing couldn’t be worse. With the 2028 election cycle already heating up, this ruling sets the stage for another drawn-out counting drama. Expect swing states to suddenly discover boxes of ballots days after polls close.

What’s particularly galling is how this decision ignores the obvious security concerns. When ballots arrive after Election Day, the chain of custody gets murky. Who’s verifying these are legitimate votes? How do we know they weren’t filled out after people saw the results?
