January 1, Supreme Court Rules Against Air Force Lt. Col

The Supreme Court refused to hear a case brought by Air Force Lt. Col. Jonathan Dunn, who was removed from his command after refusing the COVID-19 vaccine, citing a religious exemption.

The justices did not provide their reasons for refusing to hear the case. Court records show that Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch dissented but did not expand further.

Dunn’s removal from his command will remain in place while he goes through the appeals process.

Dunn had filed an emergency request with the Supreme Court, saying he was seeking “protection against further punishment, including a discharge.”

The Air Force found “that vaccination of service members is an essential component of military readiness and is critical to protecting the health and safety of service members,” said Elizabeth Prelogar, the Justice Department’s Solicitor General.
