A federal appeals court handed illegal immigrants a massive legal victory Tuesday, blocking the Internal Revenue Service from sharing basic address information with immigration enforcement. The ruling could cripple President Trump’s deportation efforts and protect criminal aliens from removal.

The U.S. Court of Appeals for the District of Columbia Circuit — packed with liberal appointees — ruled that ICE cannot access the last known addresses of 1.28 million suspected illegal migrants from IRS records. The court claimed the data-sharing violated a federal tax-confidentiality law passed after Watergate, even though the information could help remove dangerous criminals from American communities.

Last year, the IRS shared roughly 47,000 taxpayer addresses with ICE under a common-sense policy designed to support President Trump’s mass deportation agenda. Immigration officials used the data to locate and remove illegal aliens who had already received final deportation orders but were evading authorities.

A lower-court judge — also a Democratic appointee — sided with open-borders activists and blocked the policy. By that time, ICE had already received 47,289 taxpayer records, but the ruling prevents any future cooperation between the agencies.

The Trump administration appealed, arguing the decision severely hampers federal law enforcement’s ability to protect Americans from illegal immigration.

But Judge Cornelia Pillard, appointed by Barack Obama, dismissed those concerns with shocking indifference.

“But that’s a gripe with Congress, not the court,” Pillard wrote in Tuesday’s ruling.

Pillard claimed the IRS procedures violated federal law by not requiring ICE to provide specific justification for each individual address request. She called it “most egregious” that ICE didn’t submit separate paperwork for every single taxpayer in the 1.28 million-record database.

“The IRS failed to require ICE to provide a ‘specific reason’ why the requested return information ‘is or may be relevant to [a qualifying] proceeding or investigation,’ as the statute demands,” Pillard wrote.

“It entirely fails to ensure that ICE lists a federal employee, let alone one ‘personally and directly engaged’ in a qualifying investigation of a particular taxpayer. That failure has serious consequences. When ICE requested information on 1.28 million taxpayers in the summer of 2025, ICE identified the same person as the point of contact for every single request.”

The judge argued the practice “automates the review of millions of records without any individual review or any other means of ensuring compliance with the legal prerequisites to releasing each individual taxpayer’s information.”

The three-judge panel went even further, ruling that sharing addresses with immigration enforcement would violate the privacy rights of illegal aliens.

“The Data-Exchange Procedure reduces noncitizens’ privacy rights in their tax returns. By providing a distinct, automated pathway for ICE to request noncitizens’ information, the Data-Exchange Procedure deprives noncitizens of the protections that section 6103 guarantees to all taxpayers,” the court found.

The Department of Homeland Security fired back, saying it strongly disagrees with the ruling.

“[We] will continue using every lawful tool available to locate and remove illegal aliens with final orders of removal,” a DHS spokesperson said.

Why It Matters

Working Americans are fed up with a two-tiered justice system that bends over backward to protect illegal immigrants while making life harder for citizens. These are people who broke our laws to enter the country, many with criminal records, yet liberal judges grant them more privacy protections than law-abiding taxpayers. When ICE can’t even access an address to enforce a lawful deportation order, our sovereignty means nothing. Middle America knows the truth: the swamp will use any excuse — even a 50-year-old Watergate law — to sabotage border security and keep Trump from delivering on his promises.
