House Judiciary Chairman Jim Jordan is pushing for former special counsel Jack Smith to testify behind closed doors about his work on high-profile prosecutions of Donald Trump. Jordan set a December 17 date for Smith’s deposition, seeking more information on how these cases were handled by the Department of Justice.
Many Republicans accuse Smith of overreaching, pointing out that his investigations swept up lawmakers, Trump supporters, and conservative media. Smith has said his actions were lawful and necessary, and that he has nothing to hide.
Smith filed criminal charges against Trump over the 2020 election and for handling classified documents, but dropped both cases after Trump’s election victory, citing a DOJ policy that avoids prosecution of current presidents.
Peter Koski, Smith’s attorney, said, “We are disappointed that offer was rejected, and that the American people will be denied the opportunity to hear directly from Jack on these topics.” He added that Smith looks forward to working with the committee to set the record straight.
Ranking Democrat Jamie Raskin criticized the closed-door meeting, insisting that the public deserves unfiltered transparency. Raskin claims Republicans want to control the narrative by keeping Smith’s responses out of public view.
Jordan’s subpoena requests all documents and communications related to Smith’s time as special counsel after the DOJ allowed Smith to give unrestricted testimony.
