The Justice Department has asked for a seven-day delay to respond to a court deadline about deported Venezuelans. This comes right after the surprise arrest of Venezuelan President Nicolas Maduro by the U.S. military.

Judge James Boasberg had told the DOJ it must either return the deported Venezuelans or give them due process hearings. These individuals were sent to El Salvador in March 2025 for gang ties and then sent back to Venezuela in a prison swap.

According to a court filing, the DOJ claims the arrest of Maduro has changed everything in Venezuela.

“Over the weekend, the United States apprehended Nicolas Maduro,” the DOJ said. “As a result, the situation on the ground in Venezuela has changed dramatically. Defendants thus need additional time to determine the feasibility of various proposals. Defendants therefore request a 7-day extension to evaluate and determine what remedies are possible.”

So far, the judge hasn’t answered the DOJ’s request. Maduro is now being held in New York City and will face court soon. He called the deported Venezuelans his “kidnapped brothers” and wanted them returned to Venezuela.

Many of these detainees have already been released inside Venezuela following the prisoner swap. Now, no one knows where they are or what will happen next.
