Supreme Court Justice Samuel Alito put a left-wing attorney on the spot during arguments about state laws that keep men out of women’s sports. He asked simple questions about what it means to be male or female, leaving the other side grasping for answers.

The case is about whether laws keeping biological males from women’s teams violate the Constitution or Title IX. Alito pointed out that, for these laws to be fair, everyone needs to agree on what a man or woman actually is. The attorney said yes, but struggled to define either term when pressed further.

“We do not have a definition for the court, and … we’re not disputing the definition here,” the attorney admitted. She said that the state decides what’s fair, but didn’t say what makes someone male or female.

Alito kept pressing. He asked how courts can decide if there’s discrimination based on sex if “we don’t know what sex means for equal protection purposes.” The lawyer couldn’t give a straight answer, saying they use the state law as written but still argue it’s unfair.

Alito gave a clear hypothetical about a male student competing in girls’ sports without taking hormones or changing anything. He asked if the school could exclude him. The attorney agreed the school could, but then dodged about whether that student is a woman or not. She said it depends on advantage and fairness, not biology.

Alito finished by pointing out the contradiction. If someone is excluded for being transgender, is that discrimination? The attorney said that’s a separate issue and courts should review it more carefully, but didn’t clear up the confusion.

The lawyer’s refusal to define basic terms says a lot about where this argument stands in today’s America.

    Laws need to be interpreted in the context of when they were given. Title IX was written to address biological females. You can’t twist it to mean something that didn’t even exist as an issue back then.

    When you’re a Democrat you can twist any law to mean whatever you want it to. Especially if it’s totally outrageous and and against normalcy.

    ketanji jackson may be a male and she just doesn’t realize it. She may be a he or a shim. She is not a biologist so perhaps she is guessing wrong about her own gender?
