The Supreme Court decided to temporarily allow President Trump’s move to take away special temporary protected status for over 300,000 Venezuelans. This order comes after a lower court tried to block the administration from moving forward.

The justices ruled in a split decision. Justices Sotomayor, Kagan, and Jackson disagreed with letting the policy take effect for now.

“We once again use our equitable power (but not our opinion-writing capacity) to allow this Administration to disrupt as many lives as possible, as quickly as possible,” Justice Jackson wrote in her dissent.

The district court had stopped the administration’s policy earlier this year and called the decision to remove protections “unlawful.” But now the Supreme Court’s order temporarily allows the change while the final decision is still pending.

This pause only applies to Venezuelans, not Haitians or other groups.

The order will last until a higher court makes a lasting decision or until the Supreme Court agrees to take up the whole case and issues an ultimate judgment.
