Virginia Senate Democrats are moving forward with a bill, SB 749, that could turn regular gun owners into criminals just for owning certain guns or magazines. The bill redefines “assault firearms” and targets magazines over 10 rounds, threatening jail time and steep fines for violations.
“While the measure would grandfather in existing owners of these ‘assault firearms,’ such an allowance wouldn’t apply to ‘large capacity’ magazines — meaning that the legislation, if passed, would essentially turn countless Virginians into criminals overnight.”
Democrats in Virginia hold the governor’s office and both chambers, leaving little comfort for those hoping the bill will be stopped locally. Despite assurances from leaders like Gov. Abigail Spanberger about respecting the Second Amendment, campaign promises have centered on bans and tighter restrictions.
The debate isn’t staying in Richmond. Similar laws are already being challenged and making their way to the Supreme Court. Justices recently considered whether to review cases like Viramontes v. Cook County and Duncan v. Bonta, which could decide if states can ban both certain rifles and standard-size magazines.
Justice Clarence Thomas sounded the alarm over waiting, warning that the country’s most popular rifle shouldn’t be banned by government fiat. He wrote, “Such a question is of critical importance to tens of millions of law-abiding AR–15 owners throughout the country.”
Justice Brett Kavanaugh said that while the court isn’t taking up these cases now, it should address these bans soon, hinting the battle isn’t over yet. Millions are holding their breath to see if their rights are safe or if lawmakers get the green light to keep chipping away.
This isn’t just about Virginia. Gun rights for everyone in the heartland hang in the balance, depending on whether the Supreme Court decides to act.
