A federal judge is demanding Lindsey Halligan explain why she used the title of U.S. attorney for the Eastern District of Virginia in a recent indictment, even though her appointment was found unlawful.

Judge David Novak told Halligan to submit a written explanation within seven days or risk having her title struck from the indictment.

“Ms. Halligan shall further explain why [her identification] does not constitute a false or misleading statement,” said Novak.

The judge’s order points to an earlier ruling that dismissed indictments brought by Halligan against James Comey and Letitia James, because she had no legal authority to make those charges.

That ruling is being appealed, but for now, it stands and remains binding in court.

President Trump had picked Halligan to fill a key prosecutor spot after the previous attorney stepped down.

The case ties into Republican efforts to end the “blue slip” process in the Senate, which Trump says lets Democrats block qualified GOP nominees for judge and prosecutor roles.

“If they say no, then it is OVER for that very well qualified Republican candidate. Only a really far left Democrat can be approved. It is shocking that Republicans, under Senator Chuck G, allow this scam to continue. So unfair to Republicans, and not Constitutional,” Trump wrote on Truth Social.

Alina Habba, another Trump-named U.S. attorney, just left her role in New Jersey after a court also ruled her appointment unlawful.

This fight is about who gets to be in charge of the law—and if the process is fair to all Americans.
