The transition is set to take place on March 31 as the White House continues its border security overhaul.
President Donald Trump had previously announced that Kristi Noem would serve as special envoy for the Shield of the Americas.
"Trump thanked Noem for her dedicated service."
In the final vote, Senator Rand Paul joined Democrats in opposition, while two Democratic senators broke ranks to support the nominee.
Mullin will now become the ninth person to lead the department tasked with securing our borders.
