January 1, DOJ Ousts Judge’s Pick Within Hours

The Department of Justice fired Donald T. Kinsella, a 79-year-old former prosecutor, only five hours after federal judges in New York picked him to lead the office. His appointment came after the prior attorney, John A. Sarcone III, was ruled unlawfully serving by the court due to an expired appointment.

After Kinsella’s quiet swearing-in, the White House sent an email telling him he was out. Deputy Attorney General Todd Blanche said online,

“Judges don’t pick U.S. Attorneys, @POTUS does,” Blanche wrote. “See Article II of our Constitution. You are fired, Donald Kinsella.”

This action puts the spotlight on who really hires and fires top prosecutors. Judges acted under a rarely used law, but the Trump team insists only the president can decide who enforces the law.

The GOP has had trouble with judges blocking their attorney picks in other places too. In Virginia, the court tossed cases handled by a Trump pick, saying her appointment was not valid. In New Jersey, another nominee got sidelined by the courts.

The DOJ might try again with someone tied closer to the administration. This tug-of-war could head all the way to the Supreme Court.

The local judges thanked Kinsella for his “willingness to return to public service,” but gave no word on picking a new candidate.

Middle America needs to know who’s really running the justice system. Is it elected leaders or judges behind closed doors? That’s a question that hits home for folks who just want the law applied fairly and by the people they voted for.

    So, the Judges are openly defying the Constitution? Should those judges loose their licenses?
