A federal judge voided layoffs at the U.S. Agency for Global Media and Voice of America pushed by Kari Lake.
Former broadcaster Patsy Widakuswara sued Lake after she cut hundreds of employees broadcasting news worldwide.
U.S. District Judge Royce C. Lambert ruled Lake violated the Appointments Clause and Federal Vacancies Reform Act.
“Only the Appointments Clause or the Vacancies Act’s exclusive structure may authorize service as a principal officer, and Lake satisfies the requirements of neither the statute nor the Constitution,” the ruling said.
The judge declared actions by Lake as acting CEO from July 31 to Nov. 19, 2025 void, including the Aug. 29 reduction-in-force.
“Finally, the Vacancies Act specifies the result when a person exercises principal officer authority without complying with the statute. ‘An action taken by any person who is not acting’ according to the statute’s provisions ‘in the performance of any function or duty of a vacant office’ covered by the statute ‘shall have no force or effect.’ Nor may any such action ‘be ratified’ after the fact.””
President Trump named Lake VOA director in Dec. 2024 and removed six of seven International Broadcasting Advisory Board members in Jan. 2025.
The ruling noted Trump could not replace the VOA director without board quorum.
Lake posted she will appeal the outrageous ruling from an activist DC District Court Judge.
“We will appeal this outrageous ruling from an activist DC District Court Judge. Unfortunately, this image of you insulting and betraying masculinity is with us forever.”

I sincerely doubt that this rogue member of the judiciary has jurisdiction on who the executive branch hires and fires. The appointment clause has NOTHING to do with hiring or firing. VOA falls under the executive branch so there is no problem with separation of powers whatsoever. Presidential Reorganization Authority: While presidents cannot abolish agencies without Congress, they have occasionally used temporary reorganization authority granted by Congress to restructure or eliminate certain agencies or sub-agencies. For example:
Dwight D. Eisenhower used reorganization authority to create the Department of Health, Education, and Welfare in 1953. Richard Nixon used it to establish the Environmental Protection Agency (EPA) and the National Oceanic and Atmospheric Administration (NOAA) in 1970 under Reorganization Plan No. 3.
