Utah officials will soon reveal charges against Tyler James Robinson in the shooting death of Charlie Kirk. Prosecutors are considering the death penalty, which Governor Spencer Cox has pushed for in the wake of Kirk’s killing.

Robinson, just 22, is being held without bail in Utah County Jail on accusations of shooting Kirk from a nearby rooftop and fleeing the scene. Kirk, known for leading young conservatives, was killed while attending an event on campus.

“Given the very early stages of this investigation, and the fact that the investigation is ongoing, we cannot comment on the specific charges that we will file,” Utah County Attorney Jeff Gray said over the weekend.

The charges in the case include aggravated murder—a requirement if the state decides to push for the death penalty—alongside felony discharge of a firearm and obstruction of justice. Prosecutors must prove that Robinson’s alleged actions put others at grave risk to qualify for the harshest sentence.

There are strict rules in Utah about what counts as an “aggravating factor.” Defense attorney Joshua Ritter pointed out that prosecutors will likely argue the shooting endangered bystanders.

“If the jury finds that allegation to be true, then it’s game on. They would have to make the argument to the jury, there was a crowd of people around him, he’s shooting from 200 yards away…and that that could have put others in danger. Which to me, that’s a fairly easy argument to make.”

If the state pushes for the death penalty, they must file that intent within 60 days of formal charges. Other charges could bring long prison terms, with obstruction carrying up to 15 years.

Prosecutors pledged to be thorough and deliberate at every stage. Robinson has yet to appear in court or announce a lawyer as the process unfolds. There is also talk of possible federal charges, raising the stakes even higher.

President Trump voiced support for the maximum penalty if Robinson is convicted. The nation will watch closely as the legal fight over justice for Kirk’s killing begins.
