The Department of Justice is stepping into Georgia’s ongoing fight about the 2020 election. Fulton County, the biggest county in Georgia and home to Atlanta, is being ordered to hand over records about its vote counting.

State officials had pushed for months to get these documents, but the county ignored subpoenas. Now, the feds want them too, citing laws that require election officials to keep records and produce them when requested.

“Transparency seems to have been frustrated at multiple turns in Georgia,” wrote Assistant Attorney General Harmeet K. Dhillon. She pointed to a letter from the State Election Board naming “unexplained anomalies in vote tabulation and storage.”

She also noted reports of government roadblocks against getting proof like ballot scans and signature verification papers.

The secretary of state’s office did find widespread problems in how votes were handled in 2020, though state leaders don’t think the issues were enough to flip the results. Yet there’s never been a solid explanation for all the chaos, which is why the DOJ wants answers.

Dhillon said her main goal is simple: make sure Georgia is following federal laws for running elections. She explained, “The purpose of this request is to ascertain Georgia’s compliance with various provisions of the National Voter Registration Act and the Help America Vote Act.”

If states don’t play ball, they could lose Federal money. As Dhillon put it, “You’re not entitled to federal funding unless you’re complying with federal law, and so they’re not used to anybody enforcing this mechanism.”

Her division is also sending election monitors to watch the polls next week in counties across California and New Jersey, responding to requests for oversight.

While many have tried to downplay the mess in Fulton, state monitors documented pages of mismanagement and confusion during vote counting back in November 2020. The questions still haven’t all been answered.
