“The government has a compelling interest in maintaining safe, orderly, and cost-effective prison operations,” the filing states.

Under the updated policy, the Bureau of Prisons would limit hormone treatments and surgical interventions for inmates, citing both safety and taxpayer concerns.

Lower-court judges had claimed the restrictions violated inmates’ constitutional rights, prompting the administration’s emergency appeal.

Officials say the Supreme Court has previously recognized that prisons may regulate medical care based on security needs and limited resources.

Prisoners retain access to basic mental-health services under the new rules, while elective procedures are curtailed.
