The disgraced former FBI Director is asking a federal judge to throw out criminal charges against him. His defense? That cryptic post everyone saw wasn’t actually what it looked like.
The man who once ran the nation’s top law enforcement agency now finds himself on the other side of the courtroom. He’s arguing his “86 47” social media post was nothing more than protected political speech, not any kind of threat against President Donald Trump.
For those keeping score at home, “86” is restaurant slang for getting rid of something. And “47” refers to Trump being the 47th president. But we’re supposed to believe this was just innocent political commentary from a guy with an axe to grind.
This is the same bureaucrat who leaked classified government memos to the press specifically to trigger a special counsel investigation. The same one who signed off on spying on the Trump campaign. The same one who admitted under oath he was trying to set up the incoming president with that infamous Trump Tower meeting.
Now he wants us all to believe he was just exercising his First Amendment rights when he posted that message. Nothing to see here, folks. Just a concerned citizen expressing his political views.
The timing couldn’t be more convenient. With Trump back in the White House and cleaning house in the federal bureaucracy, suddenly all these Deep State operatives are discovering they might face consequences for their actions. And wouldn’t you know it, they’re all claiming they didn’t mean what everyone clearly understood them to mean.
His legal team is working overtime to spin this as a free speech issue. They want Americans to forget the context, forget the history, forget everything we know about this man’s vendetta against Trump.
The motion to dismiss relies heavily on parsing language and interpreting intent. In other words, it’s the kind of legal gymnastics that only someone with expensive lawyers and powerful connections could attempt. Regular folks don’t get this kind of creative defense strategy.
Meanwhile, January 6 defendants sat in jail for months without trial for far less. Grandmothers who walked through open doors got sentenced to prison time. But a former FBI Director posts what sure looks like a threat, and suddenly we need to have a deep philosophical discussion about the nature of political speech.
This is exactly why millions of Americans have lost faith in the justice system. There’s one set of rules for the connected elite and another for everyone else. When you’re part of the club, you get to argue about nuance and interpretation. When you’re not, you get the book thrown at you.

This case perfectly captures everything wrong with Washington. The people who spent years weaponizing federal agencies against their political enemies now cry foul when they face any accountability. They lecture us about democracy while trying to game the system they helped corrupt. Hardworking Americans see right through it — the swamp protects its own, and until that changes, there will never be equal justice under law.
