The Court will soon decide if it will hear Kim Davis’s challenge, the first real shot since the original ruling. Davis, once jailed for refusing to issue same-sex marriage licenses, wants the high court to undo what she calls a ‘legal fiction.’

Not everyone’s convinced; legal experts see little chance the Court takes this up. The hurdles are steep—four justices must agree to hear it, and five would be needed to overturn the earlier decision.

Justice Clarence Thomas has sharply criticized the ruling, arguing religious liberty was cast aside. He’s suggested these types of cases might need another look, but others on the Court aren’t signaling the same intent.

Court watchers note it took decades to overturn Roe v. Wade. There isn’t the same groundswell against same-sex marriage, so momentum is slow.

The case brought by Davis has stirred up heavy media coverage and reignited old debates. Some warn that rights could be rolled back, yet America’s support for gay marriage remains high at 68%.
