President Donald Trump announced he will be asking the Supreme Court of the United States for a rehearing of the birthright citizenship case, Trump v. Barbara.
The move comes after federal courts temporarily blocked Trump’s executive order aimed at ending automatic citizenship for children born on U.S. soil to parents who are not citizens or lawful permanent residents. Trump has made clear he believes the 14th Amendment has been grossly misinterpreted for decades.
“We’re going back to the Supreme Court,” Trump said. “They need to look at this again because what’s happening is a total abuse of our system.”
Trump has repeatedly condemned what he calls “birth tourism” — schemes where pregnant foreign nationals travel to America specifically to give birth so their children automatically become U.S. citizens. Critics of birthright citizenship argue the practice was never intended by the framers of the 14th Amendment and has been weaponized by those looking to game the immigration system.
“People are coming here just to have a baby, and that baby becomes a citizen,” Trump explained. “It’s ridiculous. No other country does this.”
The legal battle has drawn sharp lines between those who believe the Constitution’s citizenship clause applies universally to anyone born on American soil and those who argue it was meant only for children of citizens and legal residents — not illegal aliens or temporary visitors.
Conservatives have long pushed for clarity on this issue, arguing that birthright citizenship incentivizes illegal immigration and undermines the rule of law. Trump’s executive action sought to redefine who qualifies for automatic citizenship at birth, but lower courts quickly intervened.
Now, Trump is betting the Supreme Court — with its conservative majority — will take another look and rule in his favor. If successful, it would mark one of the most significant shifts in American immigration policy in modern history.

We ‘might’ be able to have a civilized conversation with the proponents of ‘birthright’ BUT not as long as they ‘grant’ that ‘privilege’ to anyone who is here illegally.
I’ll use my long standing example: if a pregnant person breaks into my garage and delivers the kid that DOES not make that child a car nor a member of my family. End of discussion.

So me and my wife are here as spies for a foreign nation if we get caught and before we are deported my wife has a baby that makes him an American citizen, can they deport him/my wife.

There is only one answer: NO
If they are here illegally in any way, that should not
benefit the child. Parents illegal, they pop a baby out and the baby is a citizen. That’s ridiculous. If I go somewhere on vacation, and my baby is born early in another country, that does not make my child a naturalized citizen. Nor do I want my child a automatic naturalized
citizen. I go into labor in Iran, and my child is a naturalized citizen of Iran. No, No effing way.
Why so much constant BS about illegals. We have had enough and are fed up with it all. Everything is constantly about illegals. There effing here illegally, deport them now, and the child is not a naturalized citizen because you got popped out here.

I think that foreign diplomats are blocked from claiming any of their children born in America are citizens. If this really is a law, then it should be applied in this case as well as it refers to foreigners.

The supreme court got this wrong. Anyone with a mind reading the 14th would come away from knowing it was meant for citizens of the usa. How we can we open out country to anyone from a foreigh conutry to come to the usa have a baby and it becomes a usa citizen entitle to all the benfits of the usa. AS they get oder they would be allowed to bring family members to the usa and they would be citizens. When i hell is all this going to stop.

So any Chinese, muslim, hasian, Somalian, Iranian or north Africa and N Korea can have a baby it’s a citizen and they can become the president!!! And they hate the USA And ITS CITIZENS!!

Many people don’t want to hear this…. but Trump is right on this one. The “Supreme” Court blew it on this one and kowtowed to the political pressure.
The application of the 14th amendment was never for everyone that steps foot in the USA and has a child gets that child citizenship. It was for those that had a generation of individuals already here, that had children and were an integral part of the country… not illegally here and those that came here legally. Those here from the immoral use of slavery were the original reason and those from original colonists off-spring… not sneaking in across our borders or traveling here for the birth of an “Anchor Baby”.

I get the issue of birth tourism, and i agree with the POTUS. But those numbers are about 26,000 (max) compared to total estimated births of illegal alien’s babies of about 320,000. That 320,000 births represent about 9% of annual US Births.
Go after the bigger problem.

I encourage everyone to actually take the time to read the Trump Vs. Barbara decision and the dissenting opinions.

Perhaps the absurdity of the majority opinion can be best illustrated by an easy example.
Chief Justice Roberts dismisses Justice Thomas’ dissent in particular in a manner that ignores, rather than disagrees with Justice Thomas’ points.

A citizen of China can arrive in the U.S. (and that includes U.S. territories in the Pacific) days before delivery, give birth, and return to China a few days later.
A child in the country for a matter of a few days, born to a citizen of China, is under the authority to make decisions regarding their child’s healthcare, education, and general welfare, including the power to consent to medical treatment, enroll the child in school, and determine where the child lives.
The parent, though in the U.S., has not established domicile, has no intent to remain in the U.S., and remains subject to of China.
Any jurisdiction the U.S. has over that parent and child is temporary and limited holding them accountable for violations of law.
When that parent returns to China the parent and the child are under the absolute jurisdiction of China, not the U.S.
China recognizes them as a citizen from birth, regardless of where they were born.
The child can be educated in China, be a member of the Young Pioneers, and vote in elections when they reach 18.
Then they can come to the U.S., register to vote in an American election after being a resident for 30 days, apply for college, apply for tuition aid, SNAP benefits, and Medicaid.
They can also go back and forth between China and the U.S. anytime they wish, which would be handy for filing reports to their handler.
NOTE: China is a country which is populated by Chinese citizens, most of whom are ethnically / racially “Chinese”.
This scenario / example could occur with citizens of any country, not just China.
However, the government of China is encouraging this Trojan horse to run roughshod over America.

Subject to jurisdiction should cover this. If yiu are not an American citizen then you are subject to the jurisdiction of your country. Of course you are subject to the laws of the country one is in. These illegals do not pledge any type of allegiance to America

Let’s discuss a constitutional amendment against that crazy birth-right citizenship. Too difficult? No, not with Systems over Goals! Here’s how it would be quite possible.
President Donald Trump prompts an OPEN constitutional convention. Open to all proposed amendments! That would get Democrats on board. If holding a convention doesn’t pass Congress, get the states to initiate the convention. Trump rallies the states to do that. Then it would happen!
We want the Democrats on board in order to convince the nation that this is not just a partisan trick. Otherwise they will block the convention from happening. Systems over Goals!
And guess who should chair it! Barack Obama! The constitutional lawyer! Then the Democrats would look stupid for opposing the convention. The convention could still pass amendments that Obama didn’t like, of course. But televise the convention live to keep up the public pressure.
Also, take the usual dirty politics out of the delegate selection. Instead, draw them at random from the voters’ lists. If someone declines, pick another name. Truly democratic. Truly credible. Then the proposed amendments are much more likely to be ratified. Systems over Goals!
Trump would go down in history as the greatest president by far, even among Democratic voters, though maybe not the party big-wigs. The convention might perform inadequately, but we must take the chance. Trust the people. Trust Trump to make it happen.
Now is the time for you to propose such a bold idea. Attract more viewers! Please actually make change on a high level. Because you have much more reach than I do.
Also, I have a few dozen great ideas for constitutional amendments.
My proposed amendment for birthright citizenship, revised:

Being born in the USA does not make a person a citizen unless 1 or more of their genetic parents are citizens and remain citizens. Surrogate mothers do not count. All of their adoptive parents and legal guardians must be citizens. To become a citizen, someone must be sponsored by 2 members of Congress, not from the same political party, and then be approved by the President or presidential agents. Naturalized citizenship shall be revoked if neither genetic parent was a citizen when the baby was born or if one or both of the parents’ USA citizenship was revoked or renounced. Naturalized citizenship also shall be revoked for a person who commits a crime. The President could make exceptions.
