A federal appeals court delivered a critical victory for Second Amendment rights Tuesday, blocking New Jersey’s attempt to bankrupt gun manufacturers through aggressive litigation tactics. The United States Court of Appeals for the Third Circuit ruled against the blue state’s efforts to stop a lawsuit filed by the National Shooting Sports Foundation (NSSF).

The case represents an 18-month legal battle over New Jersey’s scheme to hold firearm manufacturers liable for criminal misuse of their legal products. Instead of passing laws through the democratic process, Garden State politicians tried using the threat of endless lawsuits to destroy the gun industry financially.

The NSSF challenged this approach as an unconstitutional attack on both the Second Amendment and federal protections for lawful commerce in firearms. The Third Circuit’s decision allows that challenge to move forward, dealing a significant blow to anti-gun activists who’ve increasingly turned to the courts when they can’t win legislative fights.

Gun rights advocates have long warned that liability schemes like New Jersey’s represent back-door gun control. If manufacturers can be sued into bankruptcy for crimes committed by third parties using legal products, the practical effect is the same as banning firearms outright — just without the political accountability of an actual vote.

The ruling comes as Second Amendment rights face renewed pressure in blue states following recent Supreme Court decisions that strengthened constitutional protections for gun owners. Rather than accept those rulings, progressive states have searched for workarounds, with lawfare against manufacturers emerging as a favored tactic.

The Third Circuit’s decision doesn’t end the legal fight, but it keeps New Jersey from shutting down the NSSF’s constitutional challenge before it’s fully heard. That’s a win for due process and for Americans who believe fundamental rights shouldn’t be eliminated through legal gimmicks.
