January 1, Federal Court Hands Biden a Loss
U.S. District Judge Robert Summerhays handed the Biden administration a loss this week — temporarily blocking President Joe Biden from ending Title 42.
Summerhays said the order is in effect for two weeks, with a hearing set for May 13.
“The Court further concludes that the Plaintiff States have established a substantial threat of immediate and irreparable injury resulting from the early implementation of Title 42, including unrecoverable costs on healthcare, law enforcement, detention, education, and other services for migrants, and further that the balance of harms and the public interest both favor issuance of a temporary restraining order,” the judge wrote in the order.
The Centers for Disease Control and Prevention had previously announced that the policy would be removed on May 23, calling it “no longer necessary.”
