Wyatt’s Take

  • Federal judge stopped National Guard from being sent to Portland.
  • The judge said sending troops broke the law and overstepped states’ rights.
  • Calls to send troops were meant to protect federal buildings from protestors.

A federal judge in Oregon stopped the Trump administration from sending National Guard troops into Portland, blocking the order for the second time. The judge ruled that bringing in troops violated both federal law and the 10th Amendment, which protects states’ rights.

President Trump wanted to send in the National Guard to help protect a government building after violent protests broke out. The judge told Justice Department lawyers they had not provided any good reason for ignoring her earlier stop order.

“How could bringing in federalized National Guard from California not be in direct contravention of the TRO that I issued yesterday?” Immergut asked. “You’re an officer of the court. Aren’t defendants circumventing my order?”

One lawyer said they did nothing wrong, but the judge did not buy it. She said there was no emergency that justified sending new troops.

“No new information has been provided about any new issues in Portland,” Immergut said.

The judge refused the government’s last-minute request for a delay, saying nothing had changed to justify it.
